Robert Jenrick is facing allegations of advocating for a plan reminiscent of the approach associated with Donald Trump, which could potentially make the Supreme Court subordinate to influential politicians. The Shadow Justice Secretary strongly criticized judges in his recent conference speech, vowing to reinstate ministerial control over judicial appointments. Displaying a judge’s wig as a prop, he expressed his opposition to allowing any form of political activism within the judiciary.
Accusations were swiftly met by the Government, labeling Mr. Jenrick’s actions as an attack on fundamental British values and a threat to the unity maintained by traditional institutions. Former Supreme Court Justice, Lord Sumption, cautioned against Mr. Jenrick’s proposal to dismiss “activist” judges, highlighting the risks of granting British politicians increased authority over the judiciary, potentially mirroring the American system.
Emphasizing the importance of judicial independence, Deputy Prime Minister and Justice Secretary David Lammy criticized Jenrick for jeopardizing British democracy by undermining the separation of powers. In his address, Mr. Jenrick condemned judges who he believes blur the line between adjudication and activism, promising to restore the supremacy of Parliament and ministers in judicial matters.
Lord Sumption further warned that reverting to a system where judges are appointed by the Lord Chancellor could compromise public confidence in the judiciary’s impartiality. The ongoing debate raises concerns about the potential consequences of reshaping the judicial appointment process and the implications for the British legal system’s integrity.
